General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all deliveries and services provided by GH Werbebeschriftungen, Gerald Helbig, to consumers and business customers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

A business customer is a natural or legal person or a partnership with legal capacity acting in the exercise of its commercial or self-employed professional activity.

Any terms and conditions of the customer that conflict with or deviate from these Terms and Conditions shall not apply unless expressly agreed to in writing.

2. Conclusion of Contract

The presentation of products and services on this website does not constitute a legally binding offer but an invitation to place an order.

A contract shall only come into existence upon our order confirmation or upon execution of the order.

For individually manufactured products, lettering, decals, signs, license plates, or similar products, production is based solely on the data and artwork approved by the customer.

3. Prices

All prices are stated in Euro (€) and include the applicable statutory value-added tax (VAT), unless otherwise indicated.

Shipping costs will be charged separately where applicable.

4. Delivery and Shipping

Delivery shall be made to the address specified by the customer.

Delivery dates and deadlines are only binding if expressly confirmed in writing.

In the event of force majeure, operational disruptions, shortages of materials, strikes, or other unforeseen circumstances beyond our control, delivery times shall be extended accordingly.

5. Custom-Made Products

Products manufactured according to customer specifications, including decals, lettering, signs, license plates, and other customized products, are produced exclusively on the basis of information provided by the customer.

The customer is responsible for carefully reviewing all dimensions, texts, colors, and design details prior to production.

We accept no liability for errors resulting from incorrect or incomplete information supplied by the customer.

6. Copyright and Usage Rights

The customer warrants that they hold all necessary rights to any texts, images, logos, graphics, or other materials supplied to us.

The customer shall indemnify and hold GH Werbebeschriftungen harmless from any third-party claims arising from infringements of copyrights, trademarks, personality rights, or other intellectual property rights.

7. Warranty

The statutory warranty rights shall apply.

Any obvious transport damage should be reported as soon as possible after receipt of the goods. Failure to do so shall not affect the customer's statutory rights.

Minor color deviations caused by technical production processes and within customary industry tolerances shall not constitute a defect.

8. Liability

We shall be fully liable for intent, gross negligence, and for damages resulting from injury to life, body, or health.

In the event of a slightly negligent breach of essential contractual obligations, our liability shall be limited to foreseeable damages typical for the contract.

Any further liability is excluded to the extent permitted by law.

The customer is solely responsible for determining whether the supplied products are suitable for their intended purpose.

9. Special Provisions for Aircraft and Customer-Owned Property

For lettering or marking of paragliders, hang gliders, balloons, or other aircraft, the customer is responsible for ensuring and verifying the airworthiness, operational safety, and suitability of the aircraft after completion of the work.

Liability for damages resulting from any change in flight characteristics is excluded to the extent permitted by law, unless caused intentionally or through gross negligence by GH Werbebeschriftungen.

Where customer-owned items, including paragliders, hang gliders, balloon envelopes, or other equipment, are provided to us for processing or lettering, they will be handled with the due care customary in the industry.

Return shipment shall be made to the address specified by the customer using a suitable transport service provider.

We shall only be liable for loss, damage, or delays caused by the transport service provider within the scope of applicable law and any claims available against the transport service provider.

The customer is required to inform us before placing the order if the item supplied has an exceptionally high value.

Upon request and at the customer's expense, return shipment may be arranged with additional transport insurance.

Our liability for damage to customer-owned property shall otherwise be governed by the applicable statutory provisions.

10. Payment Terms

Payment may be made by advance payment, invoice, or any other payment methods offered.

We reserve the right to exclude certain payment methods in individual cases.

Unless otherwise agreed, invoices are payable within 14 days without deduction.

In the event of late payment, the statutory provisions governing default and interest shall apply.

11. Retention of Title

All goods supplied shall remain our property until full payment of all claims arising from the contractual relationship has been received.

12. Right of Withdrawal

Consumers are generally entitled to a statutory right of withdrawal.

However, the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose manufacture an individual selection or specification by the customer is decisive, or which are clearly tailored to the customer's personal needs.

This applies in particular to:

• custom-made license plates,
• individually produced decals,
• custom lettering,
• signs,
• and other made-to-order products.

13. Copyright

All texts, images, graphics, designs, layouts, and other content published on this website are protected by copyright law.

Any use, reproduction, publication, distribution, or processing, whether in whole or in part, requires our prior written consent.

14. Jurisdiction and Applicable Law

For business customers, the place of jurisdiction shall be Rosenheim, Germany.

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, the statutory provisions governing jurisdiction shall apply.

15. Final Provisions

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
